The ground rules for this website.

These terms are about the use of the website itself: what you may do with it, what you may not, and how we secure the site. Our terms and conditions apply to quotes and assignments. This is a translation for your convenience; the Dutch version prevails.

1. What these terms cover

These terms of use apply to visiting and using the website ubert.online of Ubert. By using the website you agree to these terms. If you do not agree to them, do not use the website.

These terms of use are separate from our terms and conditions. Those apply to quotes and assignments and can be found at the bottom of this page.

2. Rights to the content

This website and the content, data, texts, documents, designs, trade names, trade marks and other information available on it are protected by applicable laws and regulations and by our terms of use.

You may view the website and save or print information for your own, non-commercial use. Any other use requires our prior written consent.

3. Prohibited automated use

It is not permitted to use this website or the information available on it without permission for unauthorised automated data collection, scraping, systematic data extraction, commercial databases, lead harvesting, dataset building, AI training, machine learning, unauthorised copying or commercial re-use.

This also applies to extracting or re-using substantial parts of the content, and to the repeated and systematic extraction of insubstantial parts.

We expressly reserve our rights for text and data mining, within the meaning of article 15o of the Dutch Copyright Act and article 4(3) of Directive (EU) 2019/790. That reservation also applies in machine-readable form.

4. Name, trade marks and identity

It is not permitted to use our name, trade name, identity, trade marks, logos or company details in a way that wrongly creates the impression that there is a collaboration, representation, approval or other relationship with our organisation.

That prohibition expressly also applies to domain names, social media profiles, advertisements, email signatures, quotes and invoices of third parties.

5. Abuse and security

Abuse of our website, systems, identity or company details and other unlawful acts can be investigated and, where necessary, pursued legally.

For the security of our website, fraud prevention, abuse prevention and the establishment, exercise or defence of legal claims, technical data about website visits can be recorded, including security logs and, where applicable, IP addresses. We do that on the basis of our legitimate interest; more about this is set out in our privacy statement.

It is not permitted to circumvent the security of the website, to overload the website, to exploit vulnerabilities or to seek access to parts that are not intended for you. If you find a vulnerability, please report it to us; we appreciate that and will handle it carefully.

6. The chat assistant

This website features Ubbe, our AI chat assistant. Ubbe is an automated assistant and not an employee. Answers are informative and can contain inaccuracies; you cannot derive any rights from them. For prices, deadlines and commitments, only what is stated in writing in a quote or agreement applies.

Do not share special categories of personal data, passwords or confidential information of third parties via the chat.

7. Information on this website

We compile the information on this website with care, but we give no guarantee that it is always complete, current or free of errors. You cannot derive any rights from examples, indications and price indications.

The website can contain links to third-party sites. We are not responsible for the content and the privacy policy of those sites.

8. Liability

We are not liable for damage arising from the use of or reliance on this website, except in the event of intent or wilful recklessness on our part. For assignments, the liability provisions in our terms and conditions apply.

If you are a consumer, this limitation only applies to the extent that the law permits. Your mandatory consumer rights continue to apply in full; we do not waive them and we do not ask that of you either.

9. Changes, governing law and version

We can change these terms of use. In the event of a change that matters to you, we will ask for your agreement again on a next visit.

These terms of use are governed by Dutch law. We will submit disputes to the competent court in our district. If you are a consumer, you can always choose the court that is competent under the law, for example the one in your own place of residence; we will not take that choice away from you.
