The EU AI Act for SMEs in eight questions
Eight questions you can walk through in half an hour. They are no substitute for legal advice, but they do make clear whether there is anything you need to do and, if so, what. The full explanation is in our article on the EU AI Act.

What are you actually using
- Which AI applications are running in our business? Including the tools employees have started using on their own.
- For which of those do we have a supplier, and for which do we not?
- Do any of those applications talk directly to customers or employees?
Which category do you fall into
- Do we use AI in recruitment, selection, appraisal or dismissal? If so, stricter requirements apply.
- Do any of our applications affect someone’s access to a service, credit or insurance?
- Is there anything that is prohibited, such as emotion recognition in the workplace?
What do you need to arrange
- Is it clear to people when they are talking to AI rather than to a human?
- Do our employees know enough about AI to work with it (AI literacy, Article 4)?
If the answer to everything in the first two groups is “no”, you probably fall into the lightest category and the obligations are limited: be clear that AI is involved, and make sure your people know what they are working with. If there is a “yes” anywhere, record for each application who is responsible and how a human stays in the loop.
